Elabora\u00e7\u00e3o, aprova\u00e7\u00e3o, vincula\u00e7\u00e3o<\/p>\n<p style=\"text-align: left;\">&#8211; Conte\u00fado material<\/p>\n<p style=\"text-align: left;\">&#8211; Conte\u00fado documental<\/p>\n<p>&#8211; Efeitos registais<\/p>\n<p style=\"text-align: left;\">&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><strong>PP \u2013 OBJETO<\/strong><\/p>\n<p>O <strong>PP<\/strong> desenvolve e concretiza em detalhe as propostas de ocupa\u00e7\u00e3o de qualquer \u00e1rea do territ\u00f3rio municipal, estabelecendo regras sobre a implanta\u00e7\u00e3o das infraestruturas e o desenho dos espa\u00e7os de utiliza\u00e7\u00e3o coletiva, a implanta\u00e7\u00e3o, a volumetria e as regras para a edifica\u00e7\u00e3o e a disciplina da sua integra\u00e7\u00e3o na paisagem, a localiza\u00e7\u00e3o e a inser\u00e7\u00e3o urban\u00edstica dos equipamentos de utiliza\u00e7\u00e3o coletiva e a organiza\u00e7\u00e3o espacial das demais atividades de interesse geral.<\/p>\n<p>O <strong>PP<\/strong> abrange \u00e1reas cont\u00ednuas do territ\u00f3rio municipal, que podem corresponder a uma unidade ou subunidade operativa de planeamento e gest\u00e3o ou a parte delas.<\/p>\n<p style=\"text-align: right;\">Artigo 107.\u00ba do Decreto-Lei n.\u00ba 80\/2015, de 14 de maio<\/p>\n<p style=\"text-align: left;\">&nbsp;<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p><strong>PP \u2013 MODALIDADES&nbsp; ESPEC\u00cdFICAS<\/strong><\/p>\n<p>O <b>PP <\/b>pode assumir <b>modalidades espec\u00edficas<\/b>, com conte\u00fado material adaptado a finalidades particulares de interven\u00e7\u00e3o. Estas modalidades correspondem a formas especiais de concretiza\u00e7\u00e3o do PP, ajustadas \u00e0 natureza da \u00e1rea de interven\u00e7\u00e3o e aos objetivos que se pretendem prosseguir.<\/p>\n<p>S\u00e3o <b>modalidades espec\u00edficas de <\/b><b>PP<\/b>:<\/p>\n<p>&#8211; Plano de interven\u00e7\u00e3o no espa\u00e7o r\u00fastico;<\/p>\n<p>&#8211; PP de reabilita\u00e7\u00e3o urbana;<\/p>\n<p>&#8211; PP de salvaguarda.<\/p>\n<p>O <b>Plano de interven\u00e7\u00e3o no espa\u00e7o r\u00fastico<\/b> incide sobre <b>solo r\u00fastico <\/b>e estabelece-se regras relativas a:<\/p>\n<p>&#8211; Constru\u00e7\u00e3o de novas edifica\u00e7\u00f5es e reconstru\u00e7\u00e3o, altera\u00e7\u00e3o, amplia\u00e7\u00e3o ou demoli\u00e7\u00e3o das edifica\u00e7\u00f5es existentes, necess\u00e1rias ao exerc\u00edcio das atividades autorizadas no solo r\u00fastico;<\/p>\n<p>&#8211; Implanta\u00e7\u00e3o de infraestruturas de circula\u00e7\u00e3o e de equipamentos p\u00fablicos ou privados de utiliza\u00e7\u00e3o coletiva, e a remodela\u00e7\u00e3o, amplia\u00e7\u00e3o ou altera\u00e7\u00e3o dos existentes;<\/p>\n<p>&#8211; Cria\u00e7\u00e3o ou beneficia\u00e7\u00e3o de espa\u00e7os de utiliza\u00e7\u00e3o coletiva, p\u00fablicos ou privados, e respetivos acessos e estacionamento;<\/p>\n<p>&#8211; Cria\u00e7\u00e3o de condi\u00e7\u00f5es para a presta\u00e7\u00e3o de servi\u00e7os complementares das atividades autorizadas no solo r\u00fastico;<\/p>\n<p>&#8211; Opera\u00e7\u00f5es de prote\u00e7\u00e3o, valoriza\u00e7\u00e3o e requalifica\u00e7\u00e3o da paisagem natural e cultura.<\/p>\n<p>A sua fun\u00e7\u00e3o \u00e9, assim, permitir uma interven\u00e7\u00e3o planeada em espa\u00e7o r\u00fastico, sem alterar a respetiva classifica\u00e7\u00e3o, uma vez que esta modalidade n\u00e3o pode promover a reclassifica\u00e7\u00e3o do solo r\u00fastico em urbano.<\/p>\n<p>O <b>PP de <\/b><b>reabilita\u00e7\u00e3o urbana<\/b> abrange solo urbano correspondente, no todo ou em parte, a um <b>centro hist\u00f3rico delimitado em plano diretor ou plano de urbaniza\u00e7\u00e3o eficaz<\/b>, ou a uma <b>\u00e1rea de reabilita\u00e7\u00e3o urbana<\/b> constitu\u00edda nos termos da lei. O respetivo conte\u00fado e as suas finalidades s\u00e3o definidos no regime jur\u00eddico da reabilita\u00e7\u00e3o urbana.<\/p>\n<p>O <b>PP de <\/b><b>salvaguarda<\/b> \u00e9 a modalidade orientada para a <b>prote\u00e7\u00e3o de bens e \u00e1reas com especial valor patrimonial e cultural<\/b>. O respetivo conte\u00fado e finalidades s\u00e3o definidos nos termos previstos na lei de bases do patrim\u00f3nio cultural e demais legisla\u00e7\u00e3o complementar.<\/p>\n<p style=\"text-align: right;\">Artigos 103.\u00ba a 106.\u00ba do Decreto-Lei n.\u00ba 80\/2015, de 14 de maio<\/p>\n<p style=\"text-align: left;\">&nbsp;<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><strong>PP \u2013 ELABORA\u00c7\u00c3O, APROVA\u00c7\u00c3O, VINCULA\u00c7\u00c3O<\/strong><\/p>\n<p style=\"text-align: left;\"><b>Elabora\u00e7\u00e3o:<\/b> determinada por delibera\u00e7\u00e3o da C\u00e2mara Municipal.<\/p>\n<p style=\"text-align: left;\"><b>Aprova\u00e7\u00e3o:<\/b> compete \u00e0 Assembleia Municipal, mediante proposta da C\u00e2mara Municipal.<\/p>\n<p style=\"text-align: left;\"><b>Vincula\u00e7\u00e3o:<\/b> o PP vincula as entidades p\u00fablicas e, direta e imediatamente, os particulares.<\/p>\n<p>&nbsp;<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p><strong>PP \u2013 CONTE\u00daDO MATERIAL<\/strong><\/p>\n<p>O<b> PP <\/b>adota o conte\u00fado material apropriado \u00e0s condi\u00e7\u00f5es da \u00e1rea territorial a que respeita, aos objetivos e aos fundamentos t\u00e9cnicos previstos nos termos de refer\u00eancia e na delibera\u00e7\u00e3o municipal que determinou a sua elabora\u00e7\u00e3o, <b>estabelecendo, <\/b>nomeadamente:<\/p>\n<p>a) A defini\u00e7\u00e3o e a caracteriza\u00e7\u00e3o da \u00e1rea de interven\u00e7\u00e3o, identificando e delimitando os valores culturais e a informa\u00e7\u00e3o arqueol\u00f3gica contida no solo e no subsolo, os valores paisag\u00edsticos e naturais a proteger, bem como todas as infraestruturas relevantes para o seu desenvolvimento;<br \/>\nb) As opera\u00e7\u00f5es de transforma\u00e7\u00e3o fundi\u00e1ria preconizadas e a defini\u00e7\u00e3o das regras relativas \u00e0s obras de urbaniza\u00e7\u00e3o;<br \/>\nc) O desenho urbano, exprimindo a defini\u00e7\u00e3o dos espa\u00e7os p\u00fablicos, incluindo os espa\u00e7os de circula\u00e7\u00e3o vi\u00e1ria e pedonal e de estacionamento, bem como o respetivo tratamento, a localiza\u00e7\u00e3o de equipamentos e zonas verdes, os alinhamentos, as implanta\u00e7\u00f5es, a modela\u00e7\u00e3o do terreno e a distribui\u00e7\u00e3o volum\u00e9trica;<br \/>\nd) A distribui\u00e7\u00e3o de fun\u00e7\u00f5es, conjuga\u00e7\u00f5es de utiliza\u00e7\u00f5es de \u00e1reas de constru\u00e7\u00e3o e a defini\u00e7\u00e3o de par\u00e2metros urban\u00edsticos, designadamente, densidade m\u00e1xima de fogos, n\u00famero de pisos e altura total das edifica\u00e7\u00f5es ou altura das fachadas;<br \/>\ne) As opera\u00e7\u00f5es de demoli\u00e7\u00e3o, conserva\u00e7\u00e3o e reabilita\u00e7\u00e3o das constru\u00e7\u00f5es existentes;<br \/>\nf) As regras para a ocupa\u00e7\u00e3o e para a gest\u00e3o dos espa\u00e7os p\u00fablicos;<br \/>\ng) A implanta\u00e7\u00e3o das redes de infraestruturas, com delimita\u00e7\u00e3o objetiva das \u00e1reas que lhe s\u00e3o afetas;<br \/>\nh) Regulamenta\u00e7\u00e3o da edifica\u00e7\u00e3o, incluindo os crit\u00e9rios de inser\u00e7\u00e3o urban\u00edstica e o dimensionamento dos equipamentos de utiliza\u00e7\u00e3o coletiva, bem como a respetiva localiza\u00e7\u00e3o no caso dos equipamentos p\u00fablicos;<br \/>\ni) A identifica\u00e7\u00e3o dos sistemas de execu\u00e7\u00e3o do plano, do respetivo prazo e da programa\u00e7\u00e3o dos investimentos p\u00fablicos associados, bem como a sua articula\u00e7\u00e3o com os investimentos privados;<br \/>\nj) A estrutura\u00e7\u00e3o das a\u00e7\u00f5es de compensa\u00e7\u00e3o e de redistribui\u00e7\u00e3o de benef\u00edcios e encargos.<\/p>\n<p>O <strong>PP<\/strong> relativo a \u00e1rea n\u00e3o abrangida por PU, incluindo as interven\u00e7\u00f5es em solo r\u00fastico, procede \u00e0 pr\u00e9via explicita\u00e7\u00e3o do zonamento, dos fundamentos e dos efeitos da altera\u00e7\u00e3o do zonamento, com base na disciplina consagrada no plano diretor municipal ou plano diretor intermunicipal.<\/p>\n<p style=\"text-align: right;\">Artigo 102.\u00ba do Decreto-Lei n.\u00ba 80\/2015, de 14 de maio<\/p>\n<p style=\"text-align: left;\">&nbsp;<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p><strong>PP \u2013 CONTE\u00daDO DOCUMENTAL<\/strong><\/p>\n<p>1 \u2014 O PP \u00e9&nbsp;<b>constitu\u00eddo <\/b><b>por<\/b>:<\/p>\n<p><b>Regulamento;<\/b><\/p>\n<p><b>Planta <\/b><b>de implanta\u00e7\u00e3o<\/b>, que estabelece, designadamente, o desenho urbano e as parcelas, os alinhamentos e o pol\u00edgono base para a implanta\u00e7\u00e3o de edifica\u00e7\u00f5es, a altura total das edifica\u00e7\u00f5es ou a altura das fachadas, o n\u00famero de pisos, o n\u00famero m\u00e1ximo de fogos, a \u00e1rea de constru\u00e7\u00e3o e respetivos usos, a demoli\u00e7\u00e3o e manuten\u00e7\u00e3o ou reabilita\u00e7\u00e3o das edifica\u00e7\u00f5es existentes e a natureza e localiza\u00e7\u00e3o dos equipamentos, dos espa\u00e7os verdes e de outros espa\u00e7os de utiliza\u00e7\u00e3o coletiva;<\/p>\n<p><b>Planta de condicionantes<\/b>, que identifica as servid\u00f5es administrativas e as restri\u00e7\u00f5es de utilidade p\u00fablica em vigor, que possam constituir limita\u00e7\u00f5es ou impedimentos a qualquer forma espec\u00edfica de aproveitamento.<\/p>\n<p>2 \u2014 O PP \u00e9&nbsp;<b>acompanhado por<\/b>:<\/p>\n<p><b>Relat\u00f3rio<\/b>, contendo a fundamenta\u00e7\u00e3o t\u00e9cnica das solu\u00e7\u00f5es propostas no plano, suportada na identifica\u00e7\u00e3o e caracteriza\u00e7\u00e3o objetiva dos recursos territoriais da sua \u00e1rea de interven\u00e7\u00e3o e na avalia\u00e7\u00e3o das condi\u00e7\u00f5es ambientais, econ\u00f3micas, sociais, e culturais para a sua execu\u00e7\u00e3o;<\/p>\n<p><b>Relat\u00f3rio ambiental<\/b>, sempre que seja necess\u00e1rio proceder \u00e0 avalia\u00e7\u00e3o ambiental, no qual se identificam, descrevem e avaliam os eventuais efeitos significativos no ambiente resultantes da aplica\u00e7\u00e3o do plano e as alternativas razo\u00e1veis, tendo em conta os objetivos e o \u00e2mbito de aplica\u00e7\u00e3o territorial respetivos;<\/p>\n<p><b>Pe\u00e7as escritas e desenhadas<\/b>&nbsp;que suportem as opera\u00e7\u00f5es de transforma\u00e7\u00e3o fundi\u00e1ria previstas, nomeadamente para efeitos de registo predial e de elabora\u00e7\u00e3o ou conserva\u00e7\u00e3o do cadastro geom\u00e9trico da propriedade r\u00fastica ou do cadastro predial;<\/p>\n<p><b>Programa de execu\u00e7\u00e3o<\/b>&nbsp;das a\u00e7\u00f5es previstas;<\/p>\n<p><b>Modelo de redistribui\u00e7\u00e3o<\/b>&nbsp;de benef\u00edcios e encargos;<\/p>\n<p><b>Plano de financiamento<\/b>&nbsp;e fundamenta\u00e7\u00e3o da sustentabilidade econ\u00f3mica e financeira.<\/p>\n<p>3 \u2014 <b>Para <\/b><b>efeitos de registo predial<\/b>&nbsp;e, quando aplic\u00e1vel, para a execu\u00e7\u00e3o ou conserva\u00e7\u00e3o do cadastro geom\u00e9trico da propriedade r\u00fastica ou do cadastro predial, as pe\u00e7as escritas e desenhadas de suporte \u00e0s opera\u00e7\u00f5es de transforma\u00e7\u00e3o fundi\u00e1ria&nbsp;<b>consistem em<\/b>:<\/p>\n<p><b>Planta cadastral<\/b>&nbsp;ou ficha cadastral original, quando existente;<\/p>\n<p><b>Quadro com a identifica\u00e7\u00e3o<\/b>&nbsp;dos pr\u00e9dios, natureza, descri\u00e7\u00e3o predial, inscri\u00e7\u00e3o matricial, \u00e1reas e confronta\u00e7\u00f5es;<\/p>\n<p><b>Planta da opera\u00e7\u00e3o de transforma\u00e7\u00e3o fundi\u00e1ria<\/b>, com a identifica\u00e7\u00e3o dos novos pr\u00e9dios e dos bens de dom\u00ednio p\u00fablico;<\/p>\n<p><b>Quadro com a identifica\u00e7\u00e3o dos novos pr\u00e9dios<\/b>&nbsp;ou fichas individuais, com a indica\u00e7\u00e3o da respetiva \u00e1rea, da \u00e1rea destinada \u00e0 implanta\u00e7\u00e3o dos edif\u00edcios e das constru\u00e7\u00f5es anexas, da \u00e1rea de constru\u00e7\u00e3o, da volumetria, da altura total da edifica\u00e7\u00e3o ou da altura da fachada e do n\u00famero de pisos acima e abaixo da cota de soleira para cada um dos edif\u00edcios, do n\u00famero m\u00e1ximo de fogos e da utiliza\u00e7\u00e3o de edif\u00edcios e fogos;<\/p>\n<p><b>Planta com as \u00e1reas de ced\u00eancia<\/b>&nbsp;para o dom\u00ednio municipal;<\/p>\n<p><b>Quadro com a descri\u00e7\u00e3o das parcelas<\/b>&nbsp;a ceder, sua finalidade e \u00e1rea de implanta\u00e7\u00e3o, bem como das \u00e1reas de constru\u00e7\u00e3o e implanta\u00e7\u00e3o dos equipamentos de utiliza\u00e7\u00e3o coletiva;<\/p>\n<p><b>Quadro de transforma\u00e7\u00e3o fundi\u00e1ria<\/b>, explicitando a rela\u00e7\u00e3o entre os pr\u00e9dios origin\u00e1rios e os pr\u00e9dios resultantes da opera\u00e7\u00e3o de transforma\u00e7\u00e3o fundi\u00e1ria.<\/p>\n<p>4 \u2014 O PP \u00e9, ainda, acompanhado pelos seguintes&nbsp;<b>elementos complementares:<\/b><\/p>\n<p><b>Planta de localiza\u00e7\u00e3o<\/b>, contendo o enquadramento do plano no territ\u00f3rio municipal envolvente, com indica\u00e7\u00e3o das principais vias de comunica\u00e7\u00e3o e demais infraestruturas relevantes, da estrutura ecol\u00f3gica e dos grandes equipamentos, existentes e previstos na \u00e1rea do plano e demais elementos considerados relevantes;<\/p>\n<p><b>Planta da situa\u00e7\u00e3o existente<\/b>, com a ocupa\u00e7\u00e3o do solo e a topografia \u00e0 data da delibera\u00e7\u00e3o que determina a elabora\u00e7\u00e3o do plano;<\/p>\n<p><b>Planta ou relat\u00f3rio<\/b>, com a indica\u00e7\u00e3o dos alvar\u00e1s de licen\u00e7a e dos t\u00edtulos de comunica\u00e7\u00e3o pr\u00e9via de opera\u00e7\u00f5es urban\u00edsticas emitidos, bem como das informa\u00e7\u00f5es pr\u00e9vias favor\u00e1veis em vigor ou declara\u00e7\u00e3o comprovativa da inexist\u00eancia dos referidos&nbsp;<b>compromissos urban\u00edsticos<\/b>&nbsp;na \u00e1rea do plano;<\/p>\n<p><b>Plantas contendo os elementos t\u00e9cnicos<\/b>&nbsp;definidores da modela\u00e7\u00e3o do terreno, cotas mestras, volumetrias, perfis longitudinais e transversais dos arruamentos e tra\u00e7ados das infraestruturas;<\/p>\n<p><b>Relat\u00f3rio sobre recolha de dados ac\u00fasticos<\/b>&nbsp;ou mapa de ru\u00eddo, nos termos do n.\u00ba 2 do artigo 7.\u00ba do Regulamento Geral do Ru\u00eddo;<\/p>\n<p><b>Participa\u00e7\u00f5es<\/b>&nbsp;recebidas em sede de discuss\u00e3o p\u00fablica e respetivo relat\u00f3rio de pondera\u00e7\u00e3o;<\/p>\n<p><b>Ficha dos dados estat\u00edsticos<\/b>, em modelo a disponibilizar pela Dire\u00e7\u00e3o-Geral do Territ\u00f3rio.<\/p>\n<p>5 \u2014 O conte\u00fado documental do PP \u00e9 adaptado, de forma fundamentada, ao seu conte\u00fado material.<\/p>\n<p>6 \u2014 O PP inclui ainda indicadores qualitativos e quantitativos que permitem acompanhar e avaliar a sua execu\u00e7\u00e3o.<\/p>\n<p style=\"text-align: left;\">&nbsp;<\/p>\n<hr \/>\n<p>&nbsp;<\/p>\n<p><strong>PP \u2013 EFEITOS REGISTAIS<\/strong><\/p>\n<p><b>Constitui t\u00edtulo <\/b>bastante para a individualiza\u00e7\u00e3o no registo predial dos pr\u00e9dios resultantes das opera\u00e7\u00f5es de transforma\u00e7\u00e3o fundi\u00e1ria previstas no plano <b>a certid\u00e3o do <\/b><b>PP,<\/b> desde que contenha as men\u00e7\u00f5es constantes das al\u00edneas a) a d) e g) a i) do n.\u00ba 1 do artigo 102.\u00ba do Decreto-Lei n.\u00ba 80\/2015, de 14 de maio e seja acompanhada das pe\u00e7as escritas e desenhadas previstas no n.\u00ba 3 do artigo 107.\u00ba do mesmo diploma:<\/p>\n<p>a) Planta cadastral ou ficha cadastral original, quando existente;<\/p>\n<p>b) Quadro com a identifica\u00e7\u00e3o dos pr\u00e9dios, natureza, descri\u00e7\u00e3o predial, inscri\u00e7\u00e3o matricial, \u00e1reas e confronta\u00e7\u00f5es;<\/p>\n<p>c) Planta da opera\u00e7\u00e3o de transforma\u00e7\u00e3o fundi\u00e1ria, com a identifica\u00e7\u00e3o dos novos pr\u00e9dios e dos bens de dom\u00ednio p\u00fablico;<\/p>\n<p>d) Quadro com a identifica\u00e7\u00e3o dos novos pr\u00e9dios ou fichas individuais, com a indica\u00e7\u00e3o da respetiva \u00e1rea, da \u00e1rea destinada \u00e0 implanta\u00e7\u00e3o dos edif\u00edcios e das constru\u00e7\u00f5es anexas, da \u00e1rea de constru\u00e7\u00e3o, da volumetria, da altura total da edifica\u00e7\u00e3o ou da altura da fachada e do \u00e1reas de constru\u00e7\u00e3o e implanta\u00e7\u00e3o dos equipamentos de utiliza\u00e7\u00e3o coletiva;<\/p>\n<p>g) Quadro de transforma\u00e7\u00e3o fundi\u00e1ria, explicitando a rela\u00e7\u00e3o entre os pr\u00e9dios origin\u00e1rios e os pr\u00e9dios resultantes da opera\u00e7\u00e3o de transforma\u00e7\u00e3o fundi\u00e1ria.<\/p>\n<p><b>Nas situa\u00e7\u00f5es de restrutura\u00e7\u00e3o da compropriedade<\/b>&nbsp;ou de&nbsp;<b>reparcelamento<\/b>, o registo predial dos pr\u00e9dios resultantes das opera\u00e7\u00f5es de transforma\u00e7\u00e3o fundi\u00e1ria previstas no plano depende da apresenta\u00e7\u00e3o, respetivamente, do acordo de reestrutura\u00e7\u00e3o da compropriedade ou do contrato de urbaniza\u00e7\u00e3o&nbsp;(n.\u00ba 2 do artigo 165.\u00ba do Decreto-Lei n.\u00ba 80\/2015, de 14 de maio).<\/p>\n<p><b>As parcelas de terreno cedidas ao munic\u00edpio&nbsp;<\/b>integram -se no dom\u00ednio municipal no ato de individualiza\u00e7\u00e3o no registo predial dos lotes respetivos e est\u00e3o sujeitas a cadastro predial.<\/p>\n<p style=\"text-align: right;\">Artigos 102.\u00ba, 107.\u00ba e 108.\u00ba do
